Privacy Policy

Brave Kids, Inc. (“Brave Kids,” “we,” “us,” or “our”) takes your privacy seriously, so we have prepared this Privacy Policy statement to explain our practices with respect to the collection, use, and disclosure of your Personal Information (defined below) when you use our website located at www.bravekids.org (our “Website”) or related-services provided by us.  We define “Personal Information” as information that allows someone to identify or contact you, including, for example, your name, address, telephone number, e-mail address, as well as any other non-public information about you that is associated with or linked to any of the foregoing information.

This Privacy Policy is a part of Brave Kids’ Terms of Use.  If any provision in this Privacy Policy is inconsistent or conflicts with any provision in the Terms of Use, this Privacy Policy will control.  Capitalized terms used in this Privacy Policy but not defined in this Privacy Policy have the meanings given to them in the Terms of Use.

1. Your Consent.  By submitting Personal Information through our Website,you agree to the terms of this Privacy Policy and you expressly consent to the processing of your Personal Information in accordance with this Privacy Policy.

2. Children’s Privacy. 
We welcome users of all ages, including children under the age of thirteen.  Due to our status as a non-profit organization, we are not required to comply with the Children’s Online Privacy Protection Act (“COPPA”).  However, we strongly encourage our users aged thirteen and under to use our Website only with parental consent and supervision.

3. A Note To Users Outside Of The United States
.  Your Personal Information may be processed in the country in which it was collected and in other countries, including the United States, where laws regarding processing of Personal Information may be less stringent than the laws in your country.

4. Collection and Use

4.1 Brave Kids collects Personal Information from you when you: (a) register for an account with Brave Kids (“Account”) and fill out the voluntary Account profile information, (b) fill out our voluntary surveys, (c) enter contests or other promotions on our Website,or (d) communicate with us via email, mail, etc.  Account profile information includes your email address and may include your name, gender, location, mailing address, phone number, homepage, your screen name for ICQ, AIM, MSN messenger, Yahoo messenger, or Skype, occupation, and date of birth. Voluntary survey information may include: your name, email address, zip code, age group, and relationship to child.  Contest information includes your name, email address, email type, mailing address, phone number, phone number type, age group, and relationship to special needs child.  We will also retain information on your behalf such as your emails and the messages you post in the Public Areas of our Website.  If you provide us feedback, we will also retain that information.  We also collect information from you when you communicate with us via phone calls or if you provide us your information in person (e.g., you sign up to receive information at our outreach programs); we may add this information to the information we already have.

4.2 Personal Information you submit to us is used either to respond to requests that you make, or to aid us in serving you better.  Brave Kids uses your Personal Information in the following ways: to provide you your Account on our network; identify you as a user in our system; provide improved administration of our Website; improve the quality of experience when you interact with our Website; send you a welcome e-mail to verify ownership of the e-mail address provided when your Account was created; send you administrative e-mail notifications, such as security or support and maintenance advisories; respond to your requests; to provide you with electronic newsletters, surveys, promotional materials, or solicit feedback; and to enable you to participate in the contests and promotions you sign up for and notify you of new initiatives.

4.3 Our servers may also automatically collect information about your use of our Website, including your browser information, which pages you visit, IP address, domain name, date/time stamp, operating system, geographic information and other information that may help us to understand your use of our Website and to improve our Website and related services we provide. This information may be collected through use of a “cookie” (a small segment of data stored on your computer).  If you choose to disable cookies, some areas of our Website may not work properly.  This information is used only for aggregate analysis of our Website; it is not tied to the identity of individual users or connected to Personal Information you may have provided.

4.4 We may create anonymous data records from Personal Information by excluding information (such as your name) that make the data personally identifiable to you (“Anonymous Information”).  We use this Anonymous Information to analyze request and usage patterns so that we may enhance our Website and related-services we provide.  Brave Kids reserves the right to use and disclose Anonymous Information to any third parties in its discretion.

5. Information Sharing and Disclosure

5.1 Brave Kids will not disclose Personal Information about you to third parties without your prior consent, except as provided in this Privacy Policy.  If you enter and win a contest or other promotion, you expressly consent to (a) Brave Kids providing your Personal Information (e.g., your name and address) to the third party providing the prize for the contest or other promotion, solely to provide you such prize and (b) Brave Kids publicly disclosing your name and the fact that you won the contest or promotion.  If we will be disclosing additional Personal Information in connection with a contest or other promotion, we will disclose that to you in a separate notice prior to your entering the contest or other promotion.  By entering such contest or other promotion, you expressly consent to such disclosures.  Brave Kids may grant access to your Personal Information to our contractors and service providers to the extent necessary for them to help us provide our Website and related-services (e.g., to provide you the services we offer you through our Website; to conduct quality assurance testing; to facilitate creation of Accounts; or to provide technical support).  These third party service providers are required not to use your Personal Information other than to provide the services requested by Brave Kids. You expressly consent to the sharing of your Personal Information with our contractors and service providers for the sole purpose of providing our Website and related-services to you.

5.2 We may also disclose your Personal Information to comply with any law or legal process (e.g., to respond to subpoenas or warrants) or to defend or establish Brave Kids’ legal rights.

5.3 If Brave Kids becomes a part of another organization, that organization will possess the Personal Information collected by Brave Kids and it will assume the rights and obligations regarding your Personal Information as described in this Privacy Policy.  Although we currently do not have a parent company, any subsidiaries, joint ventures, or other companies under a common control (collectively, “Affiliates”), we may in the future.  We may share some or all of your Personal Information with these Affiliates, in which case we will require our Affiliates to honor this Privacy Policy.

6. Public Areas.  You should be careful about your communications in Public Areas because these communications disclose your Brave Kids username and any other Personal Information you choose to provide. Brave Kids does not control disclosures in Public Areas.  Any information (including Personal Information) you include in your message board profile is available to others.

7. Choices

7.1 We offer you choices regarding the collection, use, and sharing of your Personal Information.  We will periodically send you free newsletters and e-mails that directly promote the use of our Website or related-services.  When you receive newsletters or contest or promotional communications from us, you may indicate a preference to stop receiving further communications from us and you will have the opportunity to “opt-out” by following the unsubscribe instructions provided in the e-mail you receive.  Despite your indicated e-mail preferences, we may send you notices of any updates to our Terms of Use or Privacy Policy.

7.2 You have the ability to access, edit, and delete your Account information and preferences at any time, but please note that we may be required (by law or otherwise) to keep your information and not delete it (or to keep this information for a certain time, in which case we will comply with your deletion request only after we have fulfilled such requirements).  When we delete any information, it will be deleted from the active database, but may remain in our archives.

8. Security.  We employ industry-standard technical and organizational measures to protect against unauthorized access to and unlawful interception of your Personal Information, including the use of firewalls for data storage and SSL encryption for data transmission. We also require you to enter a password to access your Account information. Please do not disclose your Account password to anyone and please change your password on a periodic basis.  However, you should know that neither we nor any other internet site can fully eliminate these security risks.

9. Other Sites. 
This Privacy Policy relates only to information collected by Brave Kids when you visit our Website. Our Website may contain links to third-party web sites which may have their own privacy policies. When you click on such a link, you will leave our site and go to another site.  During this process, another entity may collect Personal Information from you.  Brave Kids is not responsible for the content or privacy practices employed by third party websites; however, we suggest that you review the privacy policy of that third party website before you provide personal or confidential information.

10. Changes to this Privacy Policy. 
We may revise this Privacy Policy at any time but we will notify you of the changes in the same manner as described for changes to the Terms of Use in paragraph 7 of the Terms of Use.
